NLRB MODIFIES “QUICKIE” UNION REPRESENTATION RULES

On December 13, 2019, the Board issued a final rule amending its election procedures.  The NLRB uses these procedures to determine whether employees are unionized.  The new amendments extend deadlines and add steps to ensure certain disputes are resolved before employees vote.  Chairman John F. Ring announced, “These are common-sense changes to ensure expeditious elections that are fair and efficient.” The new rules provide:

  • The rule amendments allow more time for employers to prepare for the pre-election hearing.  The new rule extends the time for holding a pre-election hearing from eight calendar days to 14 business days after the petition is filed.  This allows the employer for a longer period before the opening of the hearing than is currently the case.   It also allows the parties and the Board more time to try to resolve issues without a hearing, rather than litigating issues that might have been resolved through negotiation and agreement.
  • The employer will now be required to post and distribute the Notice of Petition for Election within five business days after service of the notice of hearing.  The prior rules required posting and distribution within two business days.  The additional time will permit employers to balance this requirement with other obligations imposed on them by the filing of a petition and guarantee that employees have the benefit of the Notice of Petition for Election for a longer period before the opening of the hearing than is currently the case.
  • The new rule requires unions to respond to the employer’s position statement.  Previously, the entire burden leading up to a pre-election hearing rested on the employer, including the filing of a position statement, or risk waiving the issues at the hearing.  Under the new rule, some of the burdens are shifted to the union.  The union is now required to file a response to the employer’s position statement, or risk having their petition dismissed or the employer’s position on bargaining unit issues accepted by the Region.
  • The new rule allows employers to litigate who are supervisors and who is included in the bargaining unit before the election.  Employers will once again know who is eligible to vote in the election and customize their communication to those employees who will be voting.  Employers will also know in advance who its supervisors and front-line management are during the critical campaign period and who its union-free communications team is.
  • The new rules provide employers with more time to conduct a union-free campaign before the election.  The new rule directs Board officials to set elections no fewer than 20 days after approval of consent election agreement or order and direction of election. This change will come close to returning the pre-election timeline to the pre-expedited election rules average.

TRUMP LABOR BOARD PROPOSES EMPLOYEE FREE CHOICE ELECTION PROTECTIONS

In the middle of August, the National Labor Relations Board (NLRB) published a Notice of Proposed Rulemaking to amend Part 103 of the NLRB’s Rules and Regulations. The proposed amendment, published in the Federal Register, seeks public comment on amendments that will provide better protection to employee election rights to have a free choice on whether to be represented by a union for collective bargaining with employers.  Three amendments are proposed:

  1. Blocking Charges: The amendment seeks to replace the current blocking charge policy with a “vote-and-impound” procedure.  Elections would no longer be blocked by pending unfair labor practice charges, perhaps for years.  Rather, the amendment would provide for voting, and the ballots would be impounded until the unfair labor practice charges are resolved.
  2. Voluntary Recognition Bar: The Board proposes returning to the rule of Dana Corp. (2007), which provides that for voluntary recognition to bar a subsequent representation petition-and for a post-recognition collective-bargaining agreement to have contract-bar effect- the unit employees must receive notice that voluntary recognition has been granted, and provided a 45-day open period within which to file an election petition.
  3. Section 9(a) Recognition in the Construction Industry: The rule amendment proposes changes in the construction industry, where less-than-majority employee support bargaining relationships established under Section 8(f) cannot bar petitions for a Board election.  To bar an election based upon an alleged Section 9(a) relationship, positive evidence of majority employee support will be required, and cannot be based on contract language alone, overruling Staunton Fuel (2001).

Board Chairman John F. Ring stated: “There are few more important responsibilities entrusted to the NLRB than protecting the freedom of employees to choose, or refrain from choosing, a labor organization to represent them, including by ensuring fair and timely Board-conducted secret ballot elections. We believe that the changes we propose today further the goal of protecting this vital freedom.”

MOTIVATING EMPLOYEES THROUGH JOB DESIGN

With changing demographics and a more competitive job market, human resources are more challenged than ever before to hire, engage, maintain and keep employees happy and motivated.  Workers want more choice and flexibility in how they approach tasks.  They look for more opportunities to change duties, for exploration, to learn and to advance in their career in a less linear way.  It is not only desirable but essential for businesses to have motivated employees.  Today many human resource professionals are looking at how to design jobs, work environments, and cultures that motivate employees.

Job design is a deliberate attempt to structure the tasks and social relationships of a job to create optimal levels of variety, responsibility, autonomy, and interaction.  The primary objective of job design is to ensure a fit between the job and its performer so that the job is performed well and the job performer gains satisfaction from doing it.

There are multiple strategies for job design:

Job rotation involves moving employees from job to job at regular intervals. When employees periodically move to different jobs, the monotonous aspects of job specialization can be relieved.

Job enlargement consists of making a job larger in scope by combining additional task activities into each job through expansion.  It focuses on enlarging jobs by increasing tasks and responsibilities.

Job enrichment is focused on designing jobs that include a greater variety of work content, a higher level of knowledge and skill, provide the worker more autonomy and responsibility, and provide an opportunity for personal growth.

Research shows that there are five job components that increase the motivating potential of a job: skill variety, task identity, task significance, autonomy, and feedback.

  • Skills
    • People will be more motivated if they are using a variety of skills in their positions, rather than one thing repeatedly.
  • Task Identity
    • Employees are motivated to complete tasks if they identify with them and have seen them through from start to finish.
  • Task Significance
    • When employees feel that their work is significant to their organization, they are motivated to do well.
  • Autonomy
    • Employees like to be able to make decisions and have flexibility in their roles. Most employees will have lowered motivation if they feel they have no freedom or are being micromanaged.
  • Feedback
    • Employees need feedback (both positive and negative) in order to stay motivated.

Quality of life in a total job and work environment is also an important part of a positive and motivating experience for employees.  The elements included in ‘quality of life’ include open communication equitable reward system, employees’ job security, and satisfaction, participative management, development of employee skill, etc.  Since a significant amount of one’s life is spent at work, jobs need to provide satisfaction for sustained interest.  Jobs provide employees not only a living but also help in achieving other goals such as economic, social, political and cultural.

The concept of empowerment extends the idea of autonomy.  The idea behind empowerment is that employees have the ability to make decisions and perform their jobs effectively.  Instead of dictating roles, companies create an environment where employees thrive, feel motivated, and have the discretion to make decisions about the content and context of their jobs.  Empowerment is a contemporary way of motivating employees through job design.

A growing body of research on the relational structures of jobs suggests that interpersonal relationships play a key role in making the work experience important and meaningful to employees.  Interpersonal relationships can often enhance employees’ motivations, opportunities, and resources at work.

Though employees need to have some intrinsic motivation (internal motivation) to complete the tasks assigned to them in their roles, they also need to be motivated by their employers. By designing jobs that encompass all of the core characteristics, you can help increase employee motivation, in turn improving performance.

EMPLOYER USE OF BIOMETRIC DATA

 

The value of biometric data is that it is impervious to abuse and falsification; it enables HR Professionals to accurately monitor employee attendance and ensure buildings are accessed only by authorized personnel.  It is easy to operate and reduces administrative time.
Biometric Data

Biometric data includes measurable human biological or behavioral characteristics that can be used for identification.  It includes fingerprints, voiceprint, retina or iris scans, and scans of hands or face geometry.  In the work environment, a common example includes the use of employee fingerprints to access facilities or clock in and out through timekeeping systems.  Buddy punching is a common wage theft problem when coworkers clock in for an employee who is not at work.  The American Payroll Association estimates that 75% of all businesses lose money due to buddy punching.
Healthcare has incorporated the use of biometric data.  In some hospitals, physicians access electronic health data via a finger or iris scanning biometrics security system.  Biometrics technology can be used for patient registration and identification to ensure that medical records are properly associated with each patient.  This technology can be especially helpful to identify a child and link to the appropriate medical record, especially when a child is not able to communicate.
The use of biometric data is becoming more common and laws are continuing to develop to provide more guidance to employers about proper ways to collect, store, and use the data.  Illinois was the first state to develop legislation by passing the Biometrics Information Privacy Act (BIPA).  The Act seeks to protect individual privacy and requires employers to adopt policies regarding biometric data collection and retention, obtain consent before collecting biometric data, and take steps to securely store and protect from disclosure any biometric information that is collected.  It is only in limited circumstances that an employer is able to disclose biometric information; an employer may not sell, lease, trade, or profit from any individual’s biometric information.  Recently (1/25/19), the Supreme Court of Illinois decided that private entities can be held liable for monetary damages for technical violations of BIPA.  Numerous entities (including hotels and hospitals) have been sued for technical violations with damages awarded to each technical violation.  The penalties of BIPA can range from $1,000 to $5,000 per violation and include attorney fees.
Since 2008 when Illinois passed BIPA, both Washington and Texas passed similar laws, however, BIPA remains the only law that allows private individuals to file a lawsuit for damages stemming from a violation.  Other states considering laws on biometric data include New York, Montana, Idaho, California, Alaska, Connecticut, New Hampshire, and Massachusetts.
In order to ensure that your company is compliant, it is important to review any applicable state and federal laws related to handling employee biometric information.  Obligations extend beyond employee information and include the handling of client or third-party biometric information.  These steps are important even if your state has not passed laws that affect the organization’s use of biometric data.

STRATEGIC ISSUES AND THE PAY MODEL

Perceptions of compensation vary.  It is seen as a measure of equity and justice.  Stockholders are focused on executive compensation.  Legislators may view average annual pay changes as a guide to adjusting eligibility for social services.  Employees see compensation as a reward for their services and a job well done.  Managers will view compensation from the perspective of a labor cost, but also from a competitive perspective that enables them to recruit, engage and retain employees.  The four basic compensation policy decisions that an employer must consider in managing compensation are: 1) internal consistency, 2) external competitiveness, 3) employee contributions, and 4) administration of the pay system.  The balance between the four policies becomes the employer’s compensation strategy.

It is important that compensation is linked to an organization’s overall goals and strategies and aligned with the Human Resource strategy.  Not doing so, can lead to serious issues of employee retention, engagement, and productivity that can be laborious and expensive to repair.  Compensation for many organizations is the single largest business expense and is visible and important to employees, managers, and stockholders.  Therefore it is important to strategically plan and regularly evaluate compensation systems.  Working with your company’s executives is critical to ensuring your compensation philosophy is supporting business objectives.  Strategic objectives will include significant challenges and priorities now and over the next two to five years.  Some examples are business growth plans, key talent and training objectives, market competition, and whether or not you are in a union environment.  Some other key considerations for your compensation program are:

GET MORE OUT OF YOUR TURNOVER METRIC

Most HR departments miss an opportunity when it comes to measuring and reporting turnover.  The goal of any HR metric is to provide information on how to improve the measured item.  As Peter Drucker said, “what gets measured gets done.”  Reporting turnover as simply a percentage of the workforce can be made more meaningful and more useful by diving down into the detail and adding data and information that quantifies the cost and provides insight on root causes and how to make improvements.  Some examples of this are:

  • Along with your company’s turnover rate, add the turnover rate of competitors, giving a baseline or something to compare against
  • Add the percentage of turnover that was top performers or top salespeople, the percent of turnover in each department and for each manager, the percent in high impact jobs and hard to fill jobs
  • Add the percentage of turnover in the first year of employment, which can be linked to possible employee dissatisfaction
  • Add how long it takes to fill positions, the recruitment cost of filling the positions, and how long before they are up to the minimum productivity level
  • Add exit interview information such as how many went to work for competitors and which competitors. Exit interviews may also indicate whether turnover was preventable, which may, in turn, provide managers with information needed for improvement
  • Add the dollar impact of lost sales where applicable, i.e., sales turnover, which can be directly linked to revenue and economic impact to the company

The involuntary turnover metric is also important.  It can indicate that the company is keeping low performers which can also be costly.  With this additional information, conclusions are now more easily drawn and the cost of turnover is more tangible (i.e., the cost of losing individuals in key positions is likely higher than losing individuals in low-impact positions).  If losing hard to fill jobs, the job market may be tight and replacing these employees could be expensive.   Losing individuals with strong reputations within the industry can impact stock analysts’ assessments of your firm.  It can also send negative signals throughout your firm and the industry, which can, in turn, lead to more turnover.

Some additional information that can be helpful when included with the turnover report, include:

  • Leading causes of preventable turnover
  • Satisfaction or frustration levels of those who left which could impact the company’s external image
  • Lowest turnover rates within the firm which can provide a target for managers to aim
  • The likelihood that the person that left will take others with them.

SUPREME COURT DECISION–PUBLIC UNIONS CAN NO LONGER ENFORCE PAYMENT AMONG NON-MEMBERS

In the case of Janus v. American Federation of State, County and Municipal Employees (AFSCME), Janus, an Illinois child support specialist, filed a complaint challenging the $45 monthly fee he had to pay to the union that represents him, despite not being a member.  His charge was that his First Amendment right was violated when money is taken from non-consenting employees for a public-sector union.

On June 27, the Supreme Court ruled that public-sector “agency shop” arrangements, which mandate union fees from non-consenting public-sector employees, violate the First Amendment.  The 5-4 decision overturned a 41-year-old decision that allowed states to require public employees to pay some fees to unions that represent them, even if the workers chose not to join.

The Supreme Court decision from 1977, ruled in the Abood v. Detroit Education Association case that unions may impose fees on nonunion government workers for nonpolitical expenses including collective bargaining, administration of union contracts and internal grievance procedures.

Justice Samuel A. Alito Jr. wrote for the 5-4 majority, “We conclude that this arrangement violates the free speech rights of nonmembers by compelling them to subsidize private speech on matters of substantial public concern.”  According to Justice Alito, workers like Mr. Janus were charged about 78 percent of the dues paid by members of the union.

After concluding that the imposition of fair share fees violate the First Amendment, the Court noted that “Abood” failed to appreciate the conceptual difficulty of distinguishing in public-sector cases between union expenditures that are made for collective-bargaining purposes and those that are made to achieve political ends” and that “Abood does not seem to have anticipated the magnitude of the practical administration problems that would result in attempting to classify public-sector union expenditures as either ‘chargeable…or non-chargeable.”

This decision impacts how public-sector unions work and may have implications for private-sector labor issues.  Currently, there are 28 states that have right-to-work laws which forbid unions and employers to enter into agreements requiring employees to join a union and pay dues and fees to it in order to get or keep a job.

The Supreme Court’s ruling could affect about 5 million public sector workers in 22 states that don’t have right-to-work laws that already ban forced union dues.  The impact may further erode the power of public sector unions and/or lead unions to be more responsive and attentive to its current members.
